These Terms of Service ("Terms") govern your access to and use of the Discord bot Kaznioničar Bot ("the Bot," "we," "us," or "our"). By adding the Bot to a Discord server or otherwise interacting with it, you agree to be bound by these Terms. If you do not agree, do not use the Bot.

§01 Description of the Bot

The Bot is a moderation utility for Discord servers that helps server staff assign and track "punishment points" for members. Depending on how a server's staff configure and use the Bot, it may:

Assign a designated "punishment" role to a member and direct them to a designated channel.
Track a number of remaining punishment points/actions per member, per server.
Require a member to complete a task (e.g., typing a specific sentence, or counting numbers written out as words) in the designated channel in order to have the role removed.
Allow authorized server staff to add, reduce, or clear a member's punishment points via commands.
Allow server administrators to configure settings such as the punishment role, punishment channel, and a whitelist of roles authorized to use staff commands.

The Bot is a tool made available to server owners and staff. We do not control how individual servers choose to configure or use the Bot, and we are not responsible for how server staff apply punishments or moderate their communities.

§02 Eligibility

You must meet Discord's own minimum age and eligibility requirements to use Discord and, by extension, the Bot. If you are using the Bot on behalf of a Discord server, you represent that you have the authority to add bots to that server.

§03 Server Staff Responsibilities

If you are a server owner, administrator, or a member granted permission to use the Bot's staff commands, you agree to:

Use the Bot's moderation features in accordance with Discord's Terms of Service and Community Guidelines.
Use the Bot's punishment features reasonably and not for harassment, bullying, or abuse of server members.
Ensure that your server's own rules make clear to members that this Bot is in use and how its punishment system works.
Be solely responsible for decisions to assign, modify, or remove punishments, and for configuring roles, channels, and whitelists correctly.

§04 Acceptable Use

You agree not to:

Use the Bot to violate any applicable law or Discord's Terms of Service.
Attempt to exploit, abuse, reverse-engineer, or interfere with the Bot's normal operation (e.g., spamming commands, attempting to bypass punishment logic, or attacking the underlying infrastructure).
Use the Bot to harass, threaten, demean, or harm any individual.
Use the Bot in a server dedicated to illegal content, hate speech, or content otherwise prohibited by Discord.

§05 Availability and Changes

The Bot is provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation. We may:

Modify, update, or discontinue features of the Bot at any time.
Suspend or restrict the Bot's availability to a specific server or user if we reasonably believe these Terms or Discord's policies have been violated.
Update these Terms from time to time. Continued use of the Bot after changes take effect constitutes acceptance of the revised Terms.

§06 Data

The Bot stores limited data (such as Discord user IDs, server IDs, role/channel configuration, and punishment point counts) as needed to operate its features. See the Privacy Policy for details.

§07 Disclaimer of Warranties

The Bot is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Bot will be error-free, secure, or continuously available.

§08 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, the Bot — including damages arising from moderation actions taken by server staff using the Bot.

§09 Termination

We may terminate or suspend the Bot's access to any server, or block any user from interacting with the Bot, at any time and without notice, for conduct that we believe violates these Terms or is otherwise harmful. Server administrators may remove the Bot from their server at any time.

This Privacy Policy explains what information the Discord bot Kaznioničar Bot ("the Bot," "we," "us," or "our") collects, how it is used, and your choices regarding that information.

§01 Information We Collect

To operate its punishment-tracking features, the Bot stores the following data in its database:

Server (Guild) ID — used to store per-server settings.
Discord User IDs — used to associate punishment records with specific members.
Role and Channel IDs — the punishment role and channel configured by server administrators, and any whitelisted roles.
Punishment records — the number of remaining punishment points/actions for a member, and related message IDs used to track progress.
Server prefix settings — the custom command prefix chosen by a server, if any.

The Bot reads message content only in the specific, designated punishment channel, and only to check whether a member's message matches the expected response (e.g., a required sentence or the next expected number written as a word). Message content is not stored beyond what is needed to track progress, and is not read or logged in any other channel.

We do not collect or store: email addresses, IP addresses, payment information, direct messages, or message content outside the designated punishment channel.

§02 How We Use Information

Collected data is used solely to:

Operate the punishment/role-tracking system (assigning and removing roles, tracking progress).
Allow authorized server staff to view, add, reduce, or clear a member's punishment points.
Apply server-specific configuration (prefix, whitelist roles, punishment channel/role).

We do not sell, rent, or share collected data with third parties, and we do not use it for advertising or profiling.

§03 Data Storage and Security

Data is stored in a database controlled by the Bot's operator. We take reasonable technical measures to protect stored data from unauthorized access, but no system can be guaranteed 100% secure.

§04 Data Retention

Punishment records and server configuration are retained for as long as the Bot remains in a server and the data is needed for the Bot's functionality. Records may be deleted:

When a punishment is fully completed or removed by staff.
When the Bot is removed from a server (server-specific configuration and records may be deleted periodically thereafter).

§05 Your Rights and Choices

Server administrators can remove the Bot from their server at any time, and can reconfigure or clear settings via the Bot's commands.
Members subject to a punishment record may ask server staff or the Bot operator to have their data reviewed or deleted, subject to the legitimate need to retain records for active moderation purposes.

§06 Children's Privacy

The Bot is intended for use on Discord, which requires users to meet Discord's own minimum age requirements. We do not knowingly collect data from individuals below the age required by Discord's Terms of Service.

§07 Third-Party Services

The Bot operates on Discord's platform and is subject to Discord's own Privacy Policy and Terms of Service, in addition to this policy.

§08 Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Bot after changes take effect constitutes acceptance of the revised policy.
